PiVOTiQ Commercial Intelligence — Contract Risk Intelligence Service
South Africa · Applies to every report, page, and communication
Commercial intelligence only. Not legal advice. All findings carry 10–20% variability. PiVOTiQ Commercial Intelligence, its directors, employees and agents exclude all liability, whether in contract, delict (including negligence), for breach of statutory duty, or otherwise, for any loss, damage, cost or expense of any kind arising directly or indirectly from reliance on any output, to the maximum extent permitted by applicable law including the Consumer Protection Act 68 of 2008. Consult a qualified South African construction attorney or registered adviser before making any commercial or legal decision based on a PiVOTiQ output.
This disclaimer appears at the foot of every PiVOTiQ report, web page, and operational communication. It applies in full whether or not it is reproduced alongside a given output.
PiVOTiQ Commercial Intelligence reports are produced using AI-enabled systems informed by the submitted contract document and the intake form, and are quality-checked by a person before delivery. They are structured, practical commercial intelligence outputs built to inform commercial decision-making. They are not legal advice under the Legal Practice Act 28 of 2014, and not exhaustive contractual audits of every clause in every circumstance. Real-time CRI Live answers are produced by a different process and are not individually reviewed before display — see clause 4.
The Commercial Intelligence product suite sits upstream of legal advice — it identifies which matters warrant escalation and equips you to brief that conversation. Where formal legal opinion, legal drafting, or legal representation in any forum is required, a qualified South African construction attorney is the appropriate professional.
All findings carry an inherent 10–20% variability depending on project-specific context, contract complexity, and the completeness of the information provided. A PiVOTiQ report captures the majority of commercially significant risk in a contract — it does not claim to capture every risk in every contract. No review, human or AI-enabled, does.
This variability is disclosed deliberately. It is the reason every report is a decision-support tool rather than a substitute for the professional review appropriate to a given matter.
CRI Live responds only from the completed, quality-controlled Level 1, Level 2 and Level 3 reports issued for your contract. It does not re-read the contract document and does not generate fresh analysis beyond the scope of those released reports. This is a deliberate design constraint, and it is the reason a CRI Live answer cannot contradict the report you were issued.
Every limitation in this disclaimer that applies to a PiVOTiQ report applies equally to a CRI Live answer — it is commercial intelligence and not legal advice, it carries the same 10–20% variability described in clause 3, and it is a decision-support tool rather than a substitute for professional review. A CRI Live answer is a convenient route back to analysis you already hold. It is not a new or independent assessment, and it should not be relied on as one.
The CER Register is supplied as an editable file that you own. PiVOTiQ's responsibility attaches to the register as originally issued — the findings, clause references and Exposure, Control and Recoverability scores produced by PiVOTiQ at the point of delivery.
Once the register is edited — including where scores are revised during or after negotiation, rows are added or removed, or formulas are altered — the resulting severity bands and any figures derived from them are the product of those changes. PiVOTiQ accepts no liability for a register that has been modified after issue, or for decisions taken on the basis of a modified register. If you need the original position confirmed, retain an unedited copy of the file as issued.
PiVOTiQ reports may reference South African statutory frameworks — including the Construction Industry Development Board Act 38 of 2000 and the Construction Regulations under the Occupational Health and Safety Act 85 of 1993 — and contractual timeframes under the NEC, JBCC, GCC and FIDIC forms, and under bespoke contract forms. These references are informational. They flag statutory context relevant to an identified commercial risk; they do not constitute legal advice on statutory compliance.
Contractual and statutory time limits can be strict and non-extendable under South African law, and cannot be corrected after the relevant deadline has passed. Any timeframe referenced in a report must be verified with a qualified South African construction attorney before action is taken.
Nothing in this disclaimer excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Consumer Protection Act 68 of 2008 or any other applicable law that cannot lawfully be excluded or limited. Where liability cannot be excluded but can be limited, PiVOTiQ's liability is limited to the maximum extent permitted by that law.
